The terms for using Pncyl

1. About these terms

Pncyl is made by Hexaport Pty Ltd (ABN 74 663 475 607), an Australian company based in New South Wales ("Pncyl", "we", "us", "our"). These terms are an agreement between us and you, the person using Pncyl ("you").

By using Pncyl, creating an account or starting a plan, you agree to these terms. If you are under 18, a parent or guardian must agree to them for you.

2. What Pncyl is

Pncyl is house design software that runs in your web browser on a laptop or desktop computer. You can draw floor plans, see them in 3D, add furniture and finishes, make 3D objects from photos, and make renders.

We give you a personal, non-transferable right to use Pncyl while you follow these terms. We improve Pncyl often, so features may change; if we remove something important to a paid plan, we will tell you first.

You can start designing without an account. You need an account to make objects from photos, to keep projects across computers and to subscribe. Keep your login details to yourself and tell us straight away at hello@pncyl.com if you think someone else has used your account.

3. The free trial

New customers can use Pncyl free for 7 days. You do not need to give us a card for the trial.

At the end of the trial, choose a plan to keep designing. If you do not, Pncyl locks your account and your projects are deleted 14 days later. We will remind you by email before anything is deleted.

One trial per person. We may end a trial early if it is being misused.

4. Plans and prices

Our plans are:

  • Plus: A$14.99 a month, or A$99 a year. Includes 200 creations a month.
  • Power: A$34 a month. Includes 600 creations a month.

A "creation" is one 3D object made from photos or one 4K render. Your creations reset at the start of each monthly period (yearly Plus plans reset monthly too). Unused creations do not carry over.

All prices are in Australian dollars and include GST.

We may change our prices. If we do, we will email you at least 30 days before the new price applies to you, and it will only apply from your next renewal date after that notice. If you do not want to pay the new price, you can cancel before then (see section 6).

5. Billing and renewal

Plans renew automatically. You are charged at the start of each period: monthly plans every month, yearly plans every year, on your renewal date, until you cancel.

Payments are processed by our payment provider, Stripe. We do not store your full card details.

If a payment fails, we will try again and let you know. If it still has not gone through after 14 days, we may pause your plan until it is paid. Your projects stay safe while your plan is paused.

6. Cancelling your plan

You can cancel at any time from your account settings, or by emailing hello@pncyl.com.

  • If you cancel before your next renewal date, your plan will not renew. You keep everything in your plan until the end of the period you have already paid for.
  • Once you have been charged for a new period, cancelling takes effect at the end of that period, on the following renewal date. The period you were just charged for is not refunded, and you keep full use of your plan until it ends.

For example: if your monthly plan renews on the 10th and you cancel on the 9th, you are not charged again and your plan ends on the 10th. If you cancel on the 11th, you have already been charged for the month from the 10th, so your plan runs until the next 10th and then ends.

After your plan ends, your account locks and your projects are deleted 14 days later, unless you choose a plan again before then.

We do not give refunds if you simply change your mind. This does not affect your rights under the Australian Consumer Law (section 11).

7. Your plans, photos and designs

What you make in Pncyl is yours: your plans, projects, photos, materials and designs ("your content").

So that we can run Pncyl, you allow us to store, copy and process your content to provide the service to you. This includes sending the photos you choose to the services that turn them into 3D objects, and storing your projects so you can open them on any computer. We do not use your content to advertise, and we do not sell it.

Only upload photos and content you are allowed to use. Photos of furniture or materials from a shop are fine for planning your own home. Do not upload anything unlawful, or other people’s personal information without their permission.

8. Using Pncyl fairly

Please do not:

  • use Pncyl for anything unlawful;
  • share your account or your login with other people;
  • copy, resell or rent out Pncyl, or try to get at its source code;
  • scrape Pncyl, or overload or attack it, or get around its limits or security; or
  • use Pncyl to build a competing product.

If you do, we may suspend or close your account. If it is serious, we may do this straight away; otherwise we will warn you first.

9. Measurements, 3D objects and advice

Pncyl is a tool for planning and seeing ideas. It is only as accurate as the measurements you give it.

Objects made from photos are an estimate built from your photos and the measurement you add. Pncyl tells you how sure it is about each one; always check the real measurements before you buy, order or build.

Pncyl checks designs for common problems, but it is not architectural, engineering, building or legal advice, and it is not council approval or certification. Before you build, renovate, buy furniture or sign a lease, check the details yourself and with qualified professionals where you need to.

10. Services we rely on

Pncyl uses other companies to work: for example, hosting and storage (Google Firebase), payments (Stripe), email (Resend), and the services that make 3D objects from photos. If one of them has a problem, parts of Pncyl may be slow or unavailable for a while. We will always try to fix problems quickly.

11. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Nothing in these terms limits those rights.

12. Our responsibility to you

To the extent the law allows, and apart from your rights under section 11:

  • we provide Pncyl as it is, and do not promise it will always be available or free of errors;
  • we are not responsible for decisions you make based on your designs, such as buying furniture, signing a lease or building work; and
  • where we are allowed to limit our responsibility, it is limited to supplying the service again or refunding the fees you paid us in the 12 months before the problem.

We look after your content with reasonable care and security. If something goes wrong with your personal information, we will tell you as the law requires.

13. Pncyl’s own work

Pncyl itself (the software, its design, the built-in furniture and materials, and our name and logo) belongs to us. These terms do not give you any rights to it other than to use Pncyl as set out here.

If you send us ideas or feedback, thank you: we may use them to improve Pncyl without owing you anything for them.

14. Privacy

We collect only the personal information we need to run your account and Pncyl, such as your name, email address and payment details (held by Stripe), and we handle it under the Australian Privacy Principles. If you ask us to email you a link to Pncyl, we send that link and at most one reminder, and nothing else unless you agree.

15. Closing your account

You can close your account at any time by emailing hello@pncyl.com. If you have a paid plan, cancel it first (section 6). When your account is closed, your projects are deleted 14 days later.

We may close your account if you seriously or repeatedly break these terms, or if we stop offering Pncyl. If we stop offering Pncyl, we will give you at least 30 days’ notice, time to download your work, and a refund for any period you have paid for but cannot use.

16. Changes to these terms

We may update these terms. If a change matters to you, we will email you or tell you in Pncyl before it takes effect. For paid plans, important changes apply from your next renewal date, so you can cancel first if you do not agree.

17. The law that applies

These terms are governed by the laws of New South Wales, Australia, and you and we agree to the courts there. This does not take away any rights you have under the laws where you live.
